The statutory process for a police and crime commissioner to require a chief constable to resign or retire contains several checks and balances, to ensure that the chief constable is treated fairly.
Part of that process requires the police and crime commissioner first to obtain and take into consideration the written views of HM Chief Inspector of Constabulary.
At a later stage of the process, the police and crime commissioner is also required to consider the recommendation of the local police and crime panel. The panel is entitled to ask for the further views of HM Chief Inspector of Constabulary on the matter. In this case, the panel did so.
